Bake sales are a staple of American society. They most commonly occur in conjunction with another event or as a fundraiser. Bake sales are not likely to require inspection or a permit, unless they are a regularly occurring event or unless a complaint or illness occurs that is traced to the event.

For the most part, baked goods will not support bacterial growth or cause illness. However, even baked goods can become contaminated and cause foodborne illness if the food is not prepared and stored in a sanitary manner.

If you plan to purchase food at a bake sale, here are some items to consider:

  1. Are the foods offered safe? Only foods that will not support bacterial growth can be offered at a bake sale. The safest foods to buy at a bake sale are breads, cakes, cookies, and candies. Foods that cannot be sold at bake sales would include but are not limited to: home canned foods; homemade noodles; dairy products; baked goods requiring refrigeration such as cream pies, meringue topped pies, and cream or custard-filled baked goods and pies; meat or meat containing foods; poultry; and fish or seafood products.
  2. Are the baked goods wholesome and free from contamination? All foods must be obtained from safe sources. Only pasteurized milk can be used in foods that are available to the public. A safe water supply and clean equipment are also vital to a safe food product.
  3. Is the food properly labeled? Labels should include the name of the processor or preparer, common name of the food, and list of ingredients.
  4. Is the food adequately protected? After preparation, food must be stored, transported, and displayed in a sanitary manner. Baked goods must be individually wrapped and protected from public handling.

Protect yourself and your family. Be aware and be an informed consumer. Make sure any food you purchase or consume has been prepared, stored, and displayed in a sanitary way.
